Terms & Conditions 

1. Identity / Publisher
The website can be accessed at url www.lapensiondumoulin.com (the «Site») is owned and operated by the company SAS AJAVEN, a simplified joint-stock company with a single shareholder and capital of 360,100.00 euros, registered in the Trade and Companies Register of Paris under the number 491799383, whose head office is located at 19A rue de Châtillon, 35000 Rennes, and whose VAT number is FR31491799383.

INTRODUCTION

1.1 The Site allows customers to reserve rooms and additional services at the SAS AJAVEN hotel and restaurant (hereinafter the «Hotel-Restaurant»).
1.2 These general terms and conditions of sale (the «General Terms and Conditions of Sale») apply to the reservation of rooms and additional services within the Hotel-Restaurant (the «Services») and are those in force on the date of confirmation of your reservation on the Site. They cancel and replace any general terms and conditions of sale previously posted online and/or accepted by the Customer.
1.3 Any reservation on the Site requires consultation and unconditional acceptance of the General Terms and Conditions of Sale. It is recommended to download and/or print the General Terms and Conditions of Sale in order to keep a copy on the day of a reservation, as they are subject to modification. However, any changes made after confirmation of a booking cannot be applied to that booking.
1.4 Acceptance by the Customer of the General Terms and Conditions of Sale and of the conditions, in particular the financial conditions, of each reservation made occurs by proceeding to the reservation «By choosing to reserve, I acknowledge having read and accepted the General Terms and Conditions of Sale and the Privacy Policy of SAS AJAVEN» or any other similar box proposed on the Site.
1.5 The Customer acknowledges having all the necessary information on the Site, which includes in particular :

  • SAS AJAVEN's full contact details, which can be found in the «Legal information / General terms and conditions / General terms and conditions» section,

  • the main and essential characteristics of the accommodation and additional services offered to customers,

  • the present General Conditions, the special conditions applicable to each offer and/or hosting and/or additional service(s) and the Privacy Policy,

  • the price of accommodation and additional services offered to customers,

  • the maximum number of accommodations that can be booked by a customer,

  • the terms and means of payment accepted,

  • the duration of the contract concluded between the customer and the Hotel-Restaurant.
    1.6 The expression «Customer(s)» refers to any natural person who places an order on the Site, as a consumer, for private or professional purposes, but not related to the hotel and restaurant business.
    1.7 Being a consumer, the Customer benefits from rights that may be called into question in the event that the Services are booked by him in the exercise of a professional, commercial, industrial, artisanal or liberal activity.
    1.8 Only Customers (i) who have reached the age of majority (eighteen in most countries) and (ii) who have the legal capacity to enter into contracts, are authorized to order Services on the Site.
    1.9 The information provided by the Site is presented in French, as well as in several foreign languages.

 

SUBJECT

2.1 The General Terms and Conditions of Sale define the terms and conditions applicable to the online booking of Services on the Site.
2.2 The General Terms and Conditions of Sale do not govern the offer, reservation or order of Services offered by entities other than SAS AJAVEN and on other websites and/or mobile applications. It is recommended to check the terms and conditions of third parties.
2.4 The General Terms and Conditions of Sale apply to all stages of the reservation of Services by the Customer and to the follow-up of his reservation.

 

RESERVATION

3.1 The accommodation offers presented on the Site are accompanied by an information sheet including: type of offer, description, services included, cancellation/modification conditions, special conditions if applicable, payment terms, GTC.
3.2 The Site may propose commercial offers accessible only on the Site (e.g. «Best rate guaranteed», «Secret Hotel»). These offers may be modified at any time, and SAS AJAVEN is only bound by validated reservations.
3.3 The Customer selects the Services and is solely responsible for their choice and suitability.
3.4 For all other requests, please contact SAS AJAVEN. For reservations of five (5) rooms or more, group conditions may apply.
3.5 The reservation is deemed accepted by the customer at the end of the reservation process.
3.6 The Customer attests to the veracity of the information provided. SAS AJAVEN may refuse a reservation in the event of fraudulent use of the Site or non-compliance with the GTC.

 

BOOKING PROCESS

4.1 Reservations are made via a dematerialized reservation form on the Site.
4.2 The customer provides mandatory data (including necessary personal data). He also indicates the number of people and their age; any minor over 13 is considered an adult.
4.3 Stages: selection, secure page, choice of offer, additional services if applicable, verification, contact details, bank details if guaranteed/prepayment, acceptance of terms and conditions/privacy/special conditions, validation.

 

BOOKING CONFIRMATION

5.1 Confirmation by e-mail with booking number, summary, prices, applicable terms and conditions, after-sales service info, complaints contact.
5.2 Reservations are firm upon receipt of the confirmation e-mail.
5.3 The duration of the contract corresponds to the duration of the accommodation service specified in the booking.

 

CANCELLATION OR MODIFICATION BY THE CUSTOMER

6.1 No right of withdrawal (art. L.121-21-8 Code de la consommation).
6.2 Cancellation/modification terms are specified in the fare conditions.
6.3 Reservations with prepayment: no changes or cancellations; sums paid in advance constitute a non-refundable deposit.
6.4 A «cancel order» link allows you to cancel by entering e-mail + reservation number.
6.5 Some offers have special conditions indicated in the offer sheet.
6.6 Except for special conditions: cancellation/change free of charge only within a minimum period :

  • 5 days before arrival time in October / December / January / February / March ;

  • 7 days before arrival time in April / May / June / September ;

  • 14 days before arrival time in July / August (also valid for reservations at 7 nights, week rate: -10% standard rate).
    For cancellations received after these deadlines, the total amount of the stay will be automatically debited.
    6.7 To modify: cancel according to the above conditions and make a new reservation.
    6.8 Covid-19 before stay: no exceptional arrangements (cancellation/modification/advance/refund). If deposit paid, full payment required.

 

NO-SHOW AND INTERRUPTION OF STAY

7.1 Arrival 15h00, departure 11h00. The Customer must present himself before 18h00 or give notice of late arrival. Failure to do so after 6:00 pm will result in a one-night penalty charge (unless prepaid).
7.2 Departure after 11:00 am: an additional night will be charged as a penalty.
7.3 Cancellation before departure date: full payment of the agreed price.

 

PRICE OF SERVICES

8.1 Price indicated on the offer sheet and during booking.
8.2 Rates per room, for the number of people indicated, according to period; include only services mentioned.
8.3 Prices include VAT and exclude tourist tax.
8.4 Currency: euro. Prices in other currencies: estimated.
8.5 Prices subject to change at any time; only the confirmation price is binding.

 

PAYMENT

9.1 Except special conditions: payment at the Hotel-Restaurant at the end of your stay. In case of prepayment: non-refundable deposit.
9.2 Pre-authorization possible on arrival (price guarantee + consumption/expenses).
9.3 In case of no-show or late cancellation: use of bank details for penalties.

 

HOTEL STAY

10.1 Police form available; ID required if necessary.
10.2 Some pets allowed (leash/cage in common areas). Pets not allowed in dining rooms.
10.3 Reasonable use; departure possible without compensation, with full payment, in the event of contrary behavior, damage, vandalism; full reimbursement of damage.
10.4 Wifi: prohibition of fraudulent/illegal use (counterfeiting, illegal downloading, etc.).

 

DISPLACEMENT - FORCE MAJEURE

11.1 If unavailable: accommodation in an establishment of equivalent or higher category; transfer at SAS AJAVEN's expense.
11.2 Exemption from liability in the event of force majeure, for the duration of the event, with reasonable efforts to limit the effects.
11.3 Definition and examples (strikes, terrorism, wars, bad weather, epidemics, transport/supply blockages, earthquakes, fire, storms, floods, water damage, computer breakdowns, etc.).

 

SANITARY REGULATIONS - PROTOCOL

Commitment to comply with official rules; obligation of means; no liability except proven fault; exclusion in the event of violation by the Customer of protocol or sanitary measures.

 

PERSONAL DATA

13.1 Data processing (reservation/customer management, invoicing, payment, prospecting) in accordance with law n°2018-493 and RGPD n°2016/679.
13.2 Video surveillance in common areas.
13.3 Access/rectification/portability/deletion rights: contact contact@ariniz.com.
13.4 Information : Privacy Policy or request to contact@lapensiondumoulin.com or write to the head office : 19A rue de Châtillon, 35000 Rennes (France).
13.5 Telephone and e-mail contact details can be collected for execution; registration with BLOCTEL.

 

APPLICABLE LAW - MEDIATION - JURISDICTION

14.1 French law.
14.2 Complaints within 15 days of departure by registered letter to : SAS AJAVEN, 19A rue de Châtillon, 35000 Rennes, France, and/or e-mail contact@lapensiondumoulin.com.
14.3 Mediator : MTV Médiation Tourisme Voyage - BP 80 303 - 75823 Paris Cedex - France (www.mtv.travel/).
14.4 Exclusive jurisdiction: Paris courts.

 

GENERAL PROVISIONS

15.1 Terms and conditions modified regularly; new terms and conditions applicable on the date of publication.
15.2 T&C + Privacy Policy + T&C + special conditions = entire contract; cancellation of previous T&C.
15.3 Nullity of one stipulation does not affect the others.
